The court may instead opt to discharge the person if the defendant agrees to participate in an intervention program, such as the Traffic Offenders Intervention Program or a drug/alcohol rehabilitation program.

However, if the individual is still within the bond period, the matter will be evident on the check. The good news is that once the bond period expires, the Section 10 dismissal will no longer be visible on the record.

The good news is that once the bond period has expired, the Section 10 dismissal is officially named as a “spent conviction” under Section 12 of the Criminal Records Act 1991. This means that once the bond or rehabilitation program duration has expired, you are not obligated to disclose it to anyone, including potential employers.
