Can A Criminal Record Be Cleared In NSW? Spent Convictions Explained

A criminal record can follow you well beyond the courtroom; affecting job applications, visa eligibility, professional licensing, and even volunteer work. It’s no surprise that one of the most common questions we’re asked, long after a matter has been resolved, is whether that record can ever be cleared. In NSW, the answer is sometimes yes, through what’s known as the spent convictions scheme, but it comes with strict conditions that catch many people out.

What Does “Spent” Actually Mean?

Under the Criminal Records Act 1991 (NSW), a conviction becomes “spent” after a specified crime-free period, meaning you’re generally no longer required to disclose it, including to most employers, and it won’t appear on a standard criminal history check. Legally, once a conviction is spent, you’re treated as though you were never convicted of that offence for most purposes.

This is different from having a conviction “quashed” or overturned on appeal. A spent conviction still happened; it’s simply no longer required to be disclosed or actively held against you in most circumstances.

Judge passing sentence

Which Convictions Can Become Spent

Not every conviction qualifies. Broadly, a conviction can become spent if:

  • It resulted in a sentence of no more than 6 months imprisonment (or a non-custodial penalty like a fine, bond, or community-based order)
  • The relevant crime-free period has passed – 3 years for offences dealt with in the Children’s Court, or 10 years for matters dealt with as an adult
  • No further offence has been committed during that crime-free period

If a further offence is committed during the waiting period, the clock generally resets, and the earlier conviction remains disclosable until a fresh crime-free period has elapsed.

Convictions That Can Never Be Spent

Some convictions are excluded from the scheme entirely, regardless of how much time has passed. These generally include:

  • Sentences of more than 6 months’ imprisonment
  • Sexual offences
  • Convictions against a body corporate (companies)
  • Certain offences where a person was sentenced to imprisonment for life or an indefinite term

This is why the nature of the original charge, and how it’s ultimately dealt with by the court, can matter well beyond the immediate outcome. A conviction that results in a longer custodial sentence forecloses the possibility of it ever becoming spent, which is one of many reasons the sentencing outcome itself is worth fighting for at the time, not just the finding of guilt. This is central to how we approach matters such as assault and violent offences 或 drink driving charges, where the difference between a conviction and a non-conviction outcome, or between a suspended sentence and a custodial one, has consequences well beyond the courtroom.

What Spent Actually Protects You From

Once a conviction is legally spent in NSW:

  • You don’t have to disclose it on most job applications
  • It’s excluded from standard national police checks in most circumstances
  • Discriminating against someone for a spent conviction is unlawful in most contexts under NSW anti-discrimination law

However, there are important exceptions. Certain occupations, including those involving children, the justice system, aviation security, and some financial services roles, can still require disclosure of spent convictions as part of stringent background checking requirements. It’s important to check the specific disclosure obligations of your industry rather than assume a spent conviction is invisible in every context.

A Non-Conviction Outcome Is a Different (and Often Better) Path

It’s worth distinguishing spent convictions from a non-conviction outcome, such as a Conditional Release Order without conviction under section 10 of the Crimes (Sentencing Procedure) Act 1999. Where available, a non-conviction outcome means no criminal conviction is recorded against you at all. It doesn’t require you to wait out a crime-free period, because there was never a recorded conviction to spend in the first place.

This is often the better outcome to pursue at the time of sentencing, rather than accepting a conviction and waiting years for it to become spent. Whether a non-conviction outcome is realistically available depends heavily on the offence, your record, and how the matter is argued at sentencing; something worth discussing with a lawyer before you appear in court, not after. Our guide on what you can expect from working with a defence lawyer explains how this is approached in practice.

Checking Whether Your Conviction Is Spent

There’s no automatic notification when a conviction becomes spent – it simply becomes legally spent once the waiting period has passed without further offending. If you’re unsure whether a past conviction qualifies, or whether it will show up on an upcoming background check, it’s worth getting specific advice rather than assuming either way.
