Apprehended Violence Order

Apprehended Violence Orders (AVOs): What Happens After You’re Served In 2026

Being served with an Apprehended Violence Order can be disorienting, particularly when it arrives without warning and carries conditions that immediately affect where you can go, who you can contact, and in some cases whether you can return home. Understanding what actually happens next, procedurally and legally, is the first step to responding properly rather than reactively.

This guide walks through the process that follows being served with an AVO in NSW, what the order actually requires of you in the interim, and the decisions you’ll need to make before your first court date.

What an AVO Actually Is (and Isn’t)

An Apprehended Violence Order is a civil order, not a criminal conviction. It’s issued by a court to protect a person (the protected person or PINOP) from violence, harassment, intimidation or stalking by another person (the defendant). Importantly, an AVO being made against you is not itself a criminal finding of guilt – but breaching its conditions is a criminal offence, and can carry serious penalties including imprisonment.

Many AVOs in NSW arise alongside domestic violence charges, particularly where police have attended an incident and elected to apply for a provisional order on the spot.

The Moment You’re Served

When you’re served with an AVO, you’ll typically receive:

  • A copy of the application or provisional order
  • A list of the specific conditions you must comply with immediately
  • A court date for the matter to be heard (if it’s a provisional or interim order)

The conditions on an interim or provisional AVO apply from the moment you’re served, not from your court date. This means restrictions on contact, proximity, or even returning to a shared residence can take effect immediately, regardless of whether you agree with the allegations.

Read the Conditions Carefully

Every AVO lists specific conditions the defendant must not do. Common conditions include not approaching the protected person, not contacting them directly or indirectly (including through social media or third parties), and not going within a specified distance of their home or workplace.

Some orders also list the defendant’s own children or other named people as protected persons. It’s critical to read every condition in full. Misunderstanding what’s actually prohibited is one of the most common reasons people breach an AVO unintentionally, and a breach charge is treated as a separate, serious criminal matter in its own right.

What Happens Before Your Court Date

Between being served and your first court appearance, you generally have three options:

  1. Consent without admissions: agreeing to the order being made without accepting the allegations in it. This is often the fastest way to resolve a matter, particularly where the conditions themselves aren’t especially restrictive.
  2. Oppose the application:  contesting the order entirely, which will usually mean the matter proceeds to a defended hearing where evidence is tested.
  3. Negotiate the conditions: in many cases, the conditions of a proposed order can be negotiated before the court date, particularly around issues like access to shared property, children, or contact for co-parenting purposes.

Which path makes sense depends heavily on your specific circumstances, including whether there are related criminal charges, custody or property matters at stake, and how the conditions as drafted actually affect your life. This is exactly the kind of assessment worth making with a lawyer before you appear in court, not on the day itself.

Why the Interim Period Matters

It’s tempting to treat the period before your court date as a waiting game, but it’s often the most important window to act in. Evidence can be gathered, conditions can sometimes be varied by consent before the hearing, and your lawyer can begin preparing a response strategy rather than walking into court cold. Waiting until the court date to start thinking about your position generally means far fewer options are available to you by that point.

If You’ve Also Been Charged With an Offence

AVOs frequently accompany criminal charges, particularly in domestic violence matters. If that applies to you, it’s worth understanding what to expect procedurally at your first court appearance for domestic violence charges, since the AVO and the criminal charge, while related, are dealt with as separate legal matters with different tests and different consequences.

Getting Advice Early

An AVO can affect your living arrangements, your ability to see your children, your employment (particularly in roles requiring a Working with Children Check or firearms licence), and your criminal record if it’s breached. Getting advice as early as possible in the process, ideally before your first court date, gives you the most options for how the matter is resolved.
